Franklin Bank & Trust Company (the Bank) has always valued the privacy of its customers in disclosing proprietary information to third parties. The following outlines the Bank’s policy and the customer’s rights in disclosure of such information:

This is Franklin Bank & Trust Company’s privacy policy for customers. The following are types of customers:

  • All consumer customers who have a continuing relationship with the Bank such as:
    • Deposit account
    • Loan account
    • Credit card
    • Safe deposit box
    • Retail installment contract we hold and service
    • Self-directed Individual Retirement Account where we act as custodian or trustee
    • Financial, investment, or economic advisory services (for a fee)

The Bank will tell you the sources for nonpublic personal information collected on customers. The Bank will tell customers what measures were taken to secure that information.

Term Definitions:


Nonpublic personal information means information about customers that the Bank collects in connection with providing a financial product or service. Nonpublic personal information does not include information that is available from public sources, such as telephone directories or government records.

An affiliate is a company the Bank owns or controls, a company that owns or controls the Bank, or a company that is owned or controlled by the same company that owns or controls the Bank. Ownership does not mean complete ownership, but means owning enough to have control.

A nonaffiliated third party is a company that is not an affiliate of the Bank.

The Information That is Collected:


The Bank collects nonpublic personal information about customers from the following sources:
  • Information received from customers on applications or other forms
  • Information about transactions with the Bank
  • Information about transactions with nonaffiliated third parties
  • Information from a consumer reporting agency

Information Disclosed:


The Bank does NOT and will not disclose any nonpublic personal information about customers to anyone, except as permitted by law.

The Confidentiality, Security and Integrity of Nonpublic Personal Information:


We restrict access to nonpublic personal information about customers to those employees who need to know that information to provide products or services. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard nonpublic personal information.

Nonpublic Personal Information and Trust Customers:


Notwithstanding anything to the contrary contained in the disclosure, the Bank does not disclose any information gathered by the trust department with anyone except as necessary to complete authorized transactions, or as required by law.

Nonpublic Personal Information and Former Customers:


The Bank does not disclose nonpublic personal information about former customers, except as permitted by law.
